A woman who worked as a debt collector for 15 years says there’s a simple question that can sometimes stop collectors in their tracks:
“Can you provide written proof you have the legal right to collect this debt?”
Under the Fair Debt Collection Practices Act, consumers have the right to request verification of a debt. According to 15 USC 1692g, if you dispute a debt in writing within 30 days of first contact, collectors must stop collection efforts until they send proof that they legally own the debt.
This documentation can include details of the original creditor and records showing the debt was properly transferred to the collection agency.
Experts say sending the request in writing (preferably by certified mail) is the most effective way to trigger the legal pause on collection activity.
